Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling:
On or abour 11/30/94 on scaffold
Employees working under a roadway on a catenary scaffold were not provided
with fall
protection. One employee was on each end of the scaffold at approximately
11 and l2 feet.
Among other methods, one feasible method to reduce this hazaed is to
establish and enforce
adequate safe operating procedures.  Procedures such as those stipulated
in American National
Standard for Construction and Demolition Operations (ANSI A10.8-l988).
Elements essential
to an acceptable safe operating procedure include at a minimum:
Use of a fall protection device (safety nets, lifeline and safety belts,
or
a secured horizontal wire
rope and safety belt) when employees are working from a catenary scaffold
when the heights
reach above l0 feet.
