Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Fall hazard by standing on the top cap of a 12 foot portable
reinforce fiberglass ladder to install HVAC duct work.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish and enforce ladder safety procedures
such as that stipulated by the American National Standards Institute,
(ANSI), for ladders, portable reinforced plastic, safety requirements.
Essentail elements from ANSI A14.5-1982, Chapter 9.. Selection, care
and use, section 9.3.2 climbing and working locations, would include:
a) ANSI A14.5-1982 paragraph 9.3.2 Climbing and Working Locations:
The user shall climb or work with the body near the middle of the
step or rung. The user shall not step or stand higher than the step
or rung indicated on the lable marking the highest standing level
or a ladder. The user shall not step or stand on:
1) A ladder top cap and the top step of a step or trestle ladder,
or the bucket or pail shelf of a self-supporting ladder.
