Section 5(a)(1) of the Occupational Safety and Heatlh Act of 1970: The employer did not furnish employment and a place of employment which were free form recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazards: a) On or about November 8, 1989, at the Crude Unit Secondary Tower Asphalt Bottoms processing operations, an Ingersoll-Rand centrifugal pump, Serial #0780169, previously removed from service due to identified leakage of secondary tower asphalt, was returned to service with aknown defect prior to the performance of maintenance to assure its proper safe working condition, thereby exposing employees to potential burn injuries or death resulting from the hazards of fire and/or explosion. Among other methods, one feasible and acceptable method to correct this hazard would include, but not necessarily be limited to: 1) Ensure that an operable stand-by unit of suitable construction and capacity is available for use, or in the absence of a suitable stand-by unit, shutdown or isolate the process until the primary equipment is properly repaired and functional. 2) Establish written procedures/methods for the evaluation of defective equipment. 3) Establish written procedures/methods on the implementation of shut-down procedures, when defective equipment is identified. 4) Provide employee training and education regarding the evaluation of defective equipment and the implementation of shutdown procedures. 5) Conduct regular audits of the defective equipment evaluation and shut-down procedures, including enforcement of those procedures.
