Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to crush hazards:
(a)  employees are exposed to a crush hazard, in that, the 1968
International Loadstar winch truck, located and being used east of
the transmission shed for relocating salvaged autos to different
points throughout the yard was not provided with working brakes
that would stop and hold the truck and its load.
One feasible and acceptable abatement method, among others, to
correct this hazard is to properly repair the brake system on
this vehicle and develop and institute an inspection and maintenance
program, wherby, all motor vehicles are  inspected on a regular
basis as recognized by the industry and recommended by SAE J166-1971
