Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being burned:
(a)On or about June 30, 2000; an employee lit the contents of an old
diesel barrel;
used by the company to incinerate waste such as but not limited to paper,
cardboard, and shipping crates; with a match which resulted in an
explosion and
fire.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to:
Follow the National Fire Protection Association Codes and Standards:
(1)NFPA 82 - 1999, 2-2.2.2 which states "Explosion relief shall be
provided.  The
area of explosion relief shall be not less than 1 ft2 (0.09 m2) of relief
area for
every 100 ft3 (3 m3) of primary combustion chamber volume.  Where the
exhaust
chimney will not serve the above purpose, a door or panel shall be
provided and
arranged to allow the door or panel to return to a closed position
promptly after
pressure has been released.";
(2)NFPA 82 - 1999, 2-2.2.3(c) which states "The combustion chamber, inner
walls,
roofs, bridges, walls, and curtain walls shall be constructed so as to
withstand the
combustion temperatures involved and shall maintain their integrity under
all
operating conditions."; and
(3)NFPA 82 - 1999, 2-2.2.5 which states "Incinerators shall be designed
with
internal insulation or refractory or shall be otherwise protected by
location, guard
rails, or shields such that all areas or surfaces normally accessible to
personnel
shall not exceed 160F (71.1C)...Handles of operating doors shall not exceed
a 40F (4.4C) rise for metallic and a 60F (15.6C) rise for
nonmetallic."dles
