Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)Throughout the facility - especially in the compounding and penthouse
areas;
employees were exposed to the hazard of being struck by falling loads,
such as
sacks of bulk material suspended via electric hoists and cris-cross bag
holders that
are "below the hook devices". Load ratings were not marked. The company did
not have electric hoists and auxiliary equipment inspected on a frequent
basis
(daily to monthly) and periodic basis (at least every twelve months) to
determine
wear, deterioration and malfunction as per ASME B30.16-1998.
Among other methods, feasible and acceptable methods to correct these
hazards
include; but are not limited to:
1.Determine the load rating of the supporting structure, ensuring that it
is
at least equal to that of the hoists, or provide a structure with such a
rating, as per ANSI B30.16-1.3.2.
2.Perform frequent inspections at daily to monthly intervals and periodic
inspections at monthly to yearly intervals as per ANSI B30.16-2.1, 2.1.2.,
2.1.3., or the owner's manual. Written, dated and signed inspection
reports should be maintained at time intervals specified in ANSI B30.16-
2.1.1(b)(2).
3.Ensure that below-the-hook lifting devices ( i.e. cris cross bag
supports)
are designed, installed, and maintained in proper condition with trained
operators. Perform frequent inspections at daily to monthly intervals and
periodic inspections at monthly to yearly intervals per ANSI B30.20-1.1.,
1.2., 1.3., 1.4, 1.5 and 1.6 ( Structural and Mechanical Lifting Devices).
Records of periodic inspections shall be maintained, or the device marked
to indicate the inspection was performed per ANSI B30.20.1.2  and
1.3(b)(2).
