Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the points of operation of two press brakes: (a)Fabrication area; Chicago press brake, size 710-D, SN P-7902, used to bend and shape, point of operation was not guarded and a foot pedal was used to initiate the stroke. (b)Fabrication area; Milwaukee press brake, 150 ton, press brake no. I50-IO, SN 4006-22, used to flatten, point of operation was not guarded and a foot pedal was used to initiate the stroke. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Implement an effective "Safe Distance" Safeguarding Program as described in ANSI B11.3 - 1982, Safety Requirements for Construction, Care, and Use of Power Press Brakes. Elements of the program include: (a)Exposure prevention procedures (b)Training (c)Retraining (d)Supervision (e)Periodic inspections
