Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
The hazards of being crushed by the bucket lift arms on the mustang 940
Rubber tire front
end loader due to:
(a)Safety features such as the seat belt locking mechanism were not
being inspected on a routine basis.
(b)The operators cab was not maintained in a clean and orderly
fashion.
(c)Employees were not trained on the safety features of this
equipment.
(d)Safety equipment was replaced by other than that authorized by
the manufacture.
(e)Seat belt locking mechanism was rendered inoperative.
Possible and feasible abatement methods are:
(a)To conduct document inspections of this item and other safety
items on a daily basis.
(b)Clean and maintain the operator's cab in a clean and orderly
fashion.
(c)Employees should be trained on all safety features of this
equipment, as per the operators manual, before being allowed to
operate this equipment.
(d)Safety equipment should be replaced by equipment authorized by
the manufacturer.
