Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by shifting ice. (a)Icehouse: During break-in and normal ice handling procedures, employees using poles, picks, and other tools to move the ice were exposed to the hazard of being struck by shifting ice or being caught between the compacted ice and/or the walls of the unit. While ultimate responsibility for correcting the hazards rests with the employer given his superior knowledge of the operation, feasible and acceptable methods of abatement include but are not limited to: a)Develop work practices for the "Icehouse Break-In" that eliminate the necessity of the employees having to access the top level of the ice by placing themselves between the compacted ice and the walls of the icehouse. b)Install a harness/retrieval system inside the icehouse for employees working on the top level of the ice that will restrict the distance that an employee can fall. c)Install an ice rake or other automated system to deliver the ice to the augers.
