Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards from being struck by chain saws while cutting trees, on July 13, 1994. (a)A job briefing, work procedure and assignment were not worked out carefully before any tree job was begun. (ANSI Z133.1-1972 3. General Safety requirements, 3.1 General, 3.1.3). (b)The depth or penetration of the notch was greater than about one-third the diameter of the tree. (ANSI Z133.1 -1972 8. Safe Work Procedures, 8.5 Felling, 8.5.4.1). (c)The backcut was not made higher than the point or apex of the notch to prevent kickback of the chain saw. (ANSI S133.1-1972 8. Safe Work Procedures, 8.5 Felling,8.5.4.3). (d)The employee was allowed to cut a tree while operating the chain saw above his chest. Among other methods, one feasible and acceptable abatement method to correct these hazards is to establish specific training related to tree trimming operations such as the one offered by the National Arborist Association and American National Standards Institute, Inc. (ANSI) Z133.1 1972 Safety Requirements for Tree Pruning, Trimming, Repairing, or Removal.
