Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of being struck by sprockets that
were being hoisted
by a defective air hoist, on or about May 14, 1996.  The homemade air
hoist on the Warner
and Swasey lathe, rated at 1 ton capacity, would not support a 100 pound
sprocket.  The
hoist would lose air pressure and the weight would return to the floor.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to repair the air leaks on the hoist so that it can sustain the weights
that are applied.
