Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) On or about April 13, 1989, employees were exposed to hazard of
crushing injuries working at 2800 South Ocean Blvd., Palm Beach,
while backhoe #TLB5 was in swing and backing operations with the
rear and swing radius unguarded.
Among other methods, one feasible and acceptable method to correct this
is strict enforcement policy of guarding barricades, flags or signal
perosn utilized to prevent accidental involvement with rear of swing
radius. Reference PCSA Section B.3.3.
