Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The Employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF STRUCK BY AND CUT BY A WALK BEHIND ROTARY MOWER: a)Repair Shop, on or about 10/16/97; a John Deere walk behind rotary mower was not provided with traction neutral locks nor operable operator presence levers which would enable the mower to move in a forward direction with the cutting blades engaged without the operator in control of the mower. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method is to install and adjust traction neutral locks and repair/replace and /or adjust operator presence lever controls. Abatement certification is required for this citation.
