Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees
in that
employees were exposed to THE HAZARD OF BEING CRUSHED BY A ROLLER:
a)Hunter's Ridge Road- Lot 14, on or about 6/3/02: An employee operating
a Model CS-323C Caterpillar Roller equipped with a Rollover Protective
Structure was not wearing seat belts.
ABATEMENT NOTES:
Ensure that all employees operating the Caterpillar roller, Model CS-
323C, are wearing seat belts as required by the Manufacturer's Operating
Manual, Safety Section Page 10, which states" Before Operating Machine
Fasten Seat Belts Securely" through additional training and inspection of
the use of protective equipment.
Abatement certification must be submitted for this item.
