Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) On or about 9/13/90 - Employees are required to enter kettles to
perform blade changes and other repairs. There are 3 different size
kettles; a 19,000 liter, 10,000 liter and a 3,000 liter; all having
an 18 inch diameter manhole used for entry. Prior to entry, the
confined space was not monitored for oxygen deficiency and
atmospheric contaminants, nor was it monitored while employees were
working in the kettle. Employees were not provided with an entry
permit certifying that all hazards have been evaluated.
Among other methods, a feasible and acceptable abatement method to
correct the hazard is to:
1) Conduct atmospheric testing of confined space, prior to employee
entry, for potential oxygen deficiency and atmospheric contaminants,
and to continue monitoring while employee are working in the
confined space.
2) Implement the entry permit to ensure that all hazards have been
evaluated.
