Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that periodic
inspections of a hammerhead tower crane's hoist rope were not performed
where:  the inspection
covered the entire length of the rope, any deterioration resulting in
appreciable loss of original
strength was noted, and a determination made as to whether further use of
the rope would
constitute a hazard:
a)Bungy Jump Site - Inspections of the hoist rope were not performed on a
Raimondi hammerhead tower crane, model number ER 135, serial number TK
5515-8, where:  the inspection covered the entire length of the rope, any
deterioration resulting in appreciable loss of original strength was
noted, and a
determination made as to whether further use of the rope would constitute a
hazard, exposing employees riding on the personnel platform to assist
bungy jump
customers, to the hazard of falling from an elevation of about 190 feet to
the
river
below.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to perform periodic inspections of a hammerhead crane's
hoist rope
where:  the inspection covers the entire length of the rope, any
deterioration
resulting in appreciable loss of original strength is noted, and a
determination is
made as to whether further use of the rope would constitute a hazard as
delineated
in the American National Standards Institute/American Society of Mechanical
Engineers standard for Hammerhead Tower Cranes B 30.3, Section
3-2.4.2(b)(2)

braking means with
holding power in both directions to prevent movement of the rotating upper
structure during
operation, and not capable of being set in the holding position and
remaining so without further
action on the part of the operator:
a)Bungy Jump Site - A braking means with holding power in both directions
to
prevent movement of the rotating upper structure during operation, and
capable
of being set in the holding position and remaining so without further
action on the
part of the operator was not provided to prevent movement of rotating upper
structure (Jib) of the Raimondi hammerhead tower crane, model number ER
135,
serial number TK 5515-8, exposing employees, working next to the personnel
platform being moved and lifted by the crane, to the hazard of being
struck by
the platform.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to provide a braking means with holding power in both
directions
to prevent movement of the rotating upper structure during operation, and
capable
of being set in the holding position and remaining so without further
action on the
part of the operator as delineated in the American National Standards
Institute/American Society of Mechanical Engineers standard for Hammerhead
Tower Cranes B 30.3, Section 3-1.6.2 Slewing Brakes.

a)Bungy Jump Site - Warning or limiting devices to prevent two blocking
were not
installed on the Raimondi hammerhead tower crane, model number ER 135,
serial
number TK 5515-8, exposing employees riding on the personnel platform to
assist
bungy jump customers, to the hazard of falling from an elevation of about
190
feet to the river below.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to install warning or limiting devices to prevent two
blocking as
delineated in the American National Standards Institute/American Society of
Mechanical Engineers standard for Hammerhead Tower Cranes B 30.3, Section
3-3.2.2(a)(8) Personnel Lifting.
