Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to an injury because they were not being restrained in a forklift in case of tipping and/or rollover: a)Warehouse: An employee was observed not wearing the seatbelt while operating a forklift. It was discovered later that part of the seatbelt was missing. The seatbelt was missing because the bolt which held it on the forklift was missing. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ASME B56.1-2000 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" AND OSHA'S NEW FORKLIFT TRAINING STANDARD.
