Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to falling from an elevated forklift platform:
a.Guam Premier Outlet, Tamuning, Guam:  The pallet provided by the
employer to raise
personnel with the use of a Yale forklift was not appropriate for such
tasks. Hazards
included a lack of fall protection, platform was not adequately secured, a
means to
correctly locate the platform centered laterally on the truck was not
provided, the
working platform did not contain a slip resistant floor surface, and its
loading
capabilities/limits were unknown. An employee was exposed to a fall of 14
feet to the
ground when installing a new sign while being elevated on the pallet.
Among other means, one feasible and acceptable abatement method to correct
this hazards is:
Utilize safety platforms that meet the requirements of American Society of
Mechanical
Engineers, ASME B56.1-2000, Safety Standard for Low Lift and High Lift
Trucks,
Section 7.36 entitled Platforms - Elevating.
