Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from or being thrown from the top of the personnel lift: a) On or about December 6, 1989 and prior to, employee(s) had utilized the Genie Personnel Lift Model PLC-30 serial number 87-14332-S to change light fixtures at heights up to thirty feet without utilizing the outriggrs at all times. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the instructions provided by the manufacturer that pertain to this personnel lift as well as the instruction on the boom of the lift.
