Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of engulfment by loose pelletized fertilizer products.
a) Employees entered the west hopper in the loading area without a
trained stand-by rescue person stationed outside the hopper and
without the ready availability of rescue/retrieval equipment, on or
about January 26, 1990.
One feasible and acceptable method, among others, to correct this hazard
is to ensure a trained standby/rescue person and rescue/retrieval
equipment is provided prior to entry into confined spaces.
