Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
asphyxiation and/or burns when entering truck tanks:
a) At the tank wash platform, employees were entering truck
tanks which had not been fully tested for oxygen content,
toxicity, and flammability, nor had a retrival system been
institued for safe employee removal in case of emergency.
Among other methods, one feasible and acceptable abatement method to
correct these hazards would be to fully test the truck tank atmospheres
by lowering the gas detector from the top to the bottom of the tank, and
to have proper equipment for safe retrieval of employees in case of
emergency as contained in the Proposed OSHA Permit Required Confined
Space Standard (1910.146).
