Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being injured in a truck accident by Euclid trucks in use with defective brakes. a) On or about 08/14/90, two (2) Euclid trucks #47 and #48 were operated by employees without working service brakes, emergency stopping brakes, nor parking brakes, exposing employee(s) to a vehicle accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to meet the minimum performance criteria for brake systems for off-highway trucks, by equipping the trucks with service brakes, emergency stopping system and parking system, as recommended in Society of Automotive Engineers J166, paragraphs 4.0, 4.1, 4.2, and 4.3.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard pf being struck by a front-end loader in use without a reverse signal alarm. a) On or about 08/14/90, employee(s) were subject to being struck by a Model 75C Michigan Front-End Loader #M2889M239E245 which was not equipped with a reverse signal alarm. Among other methods, one feasible and acceptable abatement method to correct this hazard whenever there is an obstructed view to the rear, is to install a reverse signal alarm distinguishable from surrounding noise level or make available an employee to give signals whenever the operator uses reverse gear.
