Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of conducting prototype boat tests in rough water and/or high
winds, thus exposing employees to being thrown out of the boat
undergoing testing, and being run over by the boat, and/or struck by the
rotating propeller, as the unattended boat circle Lake Minneola, on or
about 09/12/90.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish requirements in the prototype boat
test procedure for acceptable water and wind conditions for various
tests, such as set forth by the American Boat and Yacht Council Inc.,
for maneuvering speed testing shall be conducted on calm water with wind
speed below 10 knots.
