Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential infections such as, but not limited to, Hepatitis B and/or Acquired Immune Deficiency Syndrome (AIDS) resulting in prolonged chronic liver dysfunction and/or death from the handling of blood/body fluids encountered in their normal job responsibilities. Employees are not being properly trained in accordance with guidelines of an infectious control program and universal precautions for blood borne pathogens. These items may be abated by the following suggestions: a) Develop in infectious control program which outlines job responsibilities for your establishment, pre and post exposure determination, universal precautions, work practices and proper handling of contaminated materials. b) Implement effective training on universal precautions and proper work practices prior to exposure. c) Develop an effective post exposure evaluation and follow-up inspection for any employees who may have been exposed to any blood or body fluids.
