Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by mobile equipment or collision with equipment, structures or machinery: (a) Truck loading area - The Model 910 CATERPILLAR, front-end loader (Serial Number 41Y01414), was left unattended with the engine running. The front-end loader had inoperable brakes, an inoperable horn, no seat belts and no back-up alarm, on or about 7/7/93. Among other methods, one feasible and acceptable abatement method to correct his hazard is instruct the operator to never leave the equipment unattended with the engine running, require the operator to correct or report apparent defects and install new seat belts and require the operator to use them.
