P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by equipment canopy guards: (a) Worksite, U S Marine, Inc. - Employee(s) operating the TOYOTA industrial truck, Model #42-5FG18, Serial #11297, was not using the seat belt to prevent employee from being accidentally thrown, on or about 12/14/93. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employee(s) utilize seat belts while operating industrial trucks.
