Public Law 91-596 Section 5(a)(1): The employer did not furnish %% employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of mobile equipment: a)East Side Of The Chlorine Dock - Employees were not using their seat belts while operating the No. 16 and No. 17 Toyota forklift trucks and the Super E model 580E Case backhoe (serial number 17037496), on or about 9/26/94. Among other methods, one feasible and acceptable abatement method to correct this hazard is to strictly enforce the use of seat belts.
