Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Mixed Material Storage bin on roof - there was no confined space entry program for employees who entered the hopper to unchoke material exposing them to an unknown environment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop a confined space entry procedure for the company that contains at least the following elements; 1) Develop an entry "permit" system. 2) Provide an instrument to measure oxygen deficiency and test the atmosphere before entry. 3) Provide a safety belt and likeline for the person entering the hopper. 4) Provide rescue equipment to include a self contained breathing apparatus. 5) Provide employee training covering all aspects of the program. (Refer to American National Standards Institute, ANSI, 'Safety Requirements for working in tanks and other confined spaces".)
