Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard(s) of asphyxiation and/or overexposure to air contaminants where employees were required to enter confined spaces, such as tank cars, and no procedures was established and/or followed to insure entry into such use. 1) The instrument used to test the atmosphere inside the tank car was not calibrated before each use. 2) The instrument used to test the atmosphere inside the tank cars only accessed 2 1/2 feet of the 60 foot long, 9 foot high cylinder. 3) The atmoshere inside the tank car was not monitored periodically during the work shift/period. 4) Rescue equipment (such as life lines, harnesses and wristlets provided was not worn by employees entering the tank cars. 5) Mechanical and exhaust ventilation ducts were positioned so that dead air spaces may be created inside the tank car. 6) Respirators provided to the employees working inside the tank did not provide the proper protection in unknown concentration of toxic/ hazardous waste atmospheres. One feasible and acceptable abatement method, among others, to correct this hazard is to develop and implement a program which includes purging the tank and testing the atmosphere with instruments that are accurate and calibrated prior to each use: to provide proper respirators and/or escape respirators based on the greater hazard that can be encountered in the tank cars; ensure that employees were and are trained in proper rescue equipment and procedures.
