Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing of likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazards of broken bones, crushing and possible death while
servicing fueling and maintaining aerial lifts which were not
serviced and inspected for safety on a frequent basis, even after
complaints concerning the safety of the lifts had been made to
the employer.
Among other methods, one feasible and acceptable method to abate this
condition is to inspect, service, and repair aerial lifts in accordance
with the manufacturer's recommendations and to remove from service any
lift until unsafe conditions disclosed by the inspection or discovered
during operation is corrected.
