Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to the possibility of chemical burns, respiratory system damage and death from possible exposure to liquid or gasious chlorine while connecting or disconnecting railroad tank cars cotnaining liquid chlorine should a valve fail or pipe rupture. Among other methods, one feasible and acceptable method to correct this hazard is to revise the company's written procedure to incorporate at least the following: 1) Immediately upon spotting the rail car, brakes are to be set, wheel chocks positioned, and connected, derailer placed in the closed position, and the blue flag properly placed on the line. 2) Employee to make the connection shall don S.C.B.A. and personal protective equipment. This equipment must include hard hat, chemical resistant suit, gloves, and protection for any other exposed body part. 3) Second employee to aid, assist, or effect a rescue must be present, in the immediate area, at all times attired in the same equipment. 4) Connection shall then be made following prescribed written company procedure. 5) This procedure shall be reversed exactly for disconnecting. 6) All employees involved shall be trained in this procedure and the procedure shall be enforced. 7) A periodic evaluation fo the program not less than once a yer, shall take place to ensure the continuing effectiveness of the program.
