Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on or about 6/7/88 employees were exposed to the hazard of toxic, and/or oxygen deficient atmosphere encountered during entry into a confined space. The hazardous condition occurred in the cleaning of a molasses truck tank trailer. This tanker trailer, Tag #AQ916R, ID #201026 owned by Cargill Inc., was 40 feet 6 inches long, 5 feet 3 inches deep at the center manhole. It had two manholes about 18 inches in diameter used for access. This tanker had been used to haul waste water and molasses. A feasible and useful method of abating this hazard is the establishment of a confined space entry procedure that would include: A Testing for toxic gases, combustible gases and oxygen content prior to employees entering the truck tanker trailer.
