Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being hit and/or struck by the bucket of the excavator:
a) On or about January 24, 1991, a Bucyrus Erie 350H Excavator
was in operation where employees were exposed to the swing
radius of the rear of the excavator due to the fact that no
barriers were erected to protect all employees in this area.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to have the operator become fully aware of the
instructions in the Bucyrus Erie 350H Operators Manual, specifically
page 8, "Start-Up Procedures".
