Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to the hazard of tripping and falling down stairs:
(a) The metal nosing strip on the top step of the stairs between the
main office and dispatch was damaged and not secured to the surface of
the step creating a tripping hazard, on or about June 20, 1991.
One feasible and acceptable abatement method would be to cover the
stair nosings with carpet glued down with proper adhesive and
eliminate the use of metal nosings.
