Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  the
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of being crushed by a front-end loader in the
event it turned over:
a)  On or about February 28, 1991, an employee operating a Case
W-4 Front-End Loader company number 1, (Serial Number, either
1216763 or 1216729, 1982 model, no ID Plates on front end
Loaders), was scooping dirt from a large pile to be spread out
along the bank, near the railroad tracks, when the front-end
loader turned over, pinning the operator underneath the front-
end loader and fataly  injuring him.
Among other methods, one feasible and acceptable method of
abatement to correct this hazard is to install the roll over
protection, which is standard equipment on this peice of
equipment, also to install seat belts.  Reference Case
