Section 5(a)(1) of the Occupational Safety and Health Act of
1970:
The employer did not furnish employment and a place of employment
which
were free from recognized hazards that were causing or likely to
cause
death or serious physical harm to employees in that employees
were
exposed to being struck by falling tree:
(a)  Burke County, Mallard Timber Tract
Employee felling hardwood saw timber had back cut and under
cut
several trees in the work area leaving them standing with
less
than 10of the tree's fibers supporting the weight of the
tree
while continuing to limb and top other tree that had been
felled, on or about 8/21/92.
Among other methods, one feasible and acceptable abatement method
to
correct this hazard is require employees to fell all lodged
trees,
widow makers and/or partially cut trees before continuing
