Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to human immunodeficiency virus (HIV), hepatitis B virus (HBV) and other bloodborne pathogens: (a) Memorial Medical Center, throughout the pneumatic tube transport system - Health care workers including but not limited to doctors, nurses, pharmacists, medical technicians, clerical, maintenance personnel, etc. were exposed to the hazard(s) of being infected by HIV and HBV as well as other bloodborne pathogens through possible direct contact with blood and/or other body fluids, on or about 4/16/91. Among other methods, one feasible and acceptable abatement method to correct this hazard: Eliminate the use of the pneumatic tube transport system as a vehicle for transporting material that has a potential of being infected or contaminated with bloodborne pathogens.
