Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed: At the construction site, eastern edge - Employee(s) riding in the bucket of the Fiat-Allis front end loader, Model RR11 (Serial Number R11B2T-5301691) were exposed to the hazard of falling off and being crushed, on or about 8/30/90. Among other methods, one feasible and acceptable abatement method to correct this hazard is strict enforcement of a policy prohibiting passengers from riding construction equipment that is not designed for carrying passengers.
