Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operators seat and being crushed by industrial lift truck: a)Chop staging area and chop area - The operator of the Model 5FG20 type LP TOYOTA forklift truck was not using the seat belts, on or about 3/19/96. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require operators of equipment that is provided with seat belts to use the seat belts.
