P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: falling from an elevated platform. a) At the construction site - Employees were exposed to fall hazards. A forklift tractor with an unapproved platform was used for lifting personnel to perform work, access and/or egress higher elevations, on or about 3/21/00. b) At the construction site - Employees were allowed to ride on an unapproved platform placed over the forks of a forklift tractor, while this equipment was traveling, on or about 03/21/00. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Provide an approved platform designed for this purpose, securely attached to the forks. 2. Prohibit the practice of riding on this platform while the forklift tractor is traveling. For additional assistance please refer to ASME B56.1-1993 (Revision of ASME/ANSI B56.1- 1988) Safety Standard of Low Lift and High Lift Trucks, Part II, Section 4.17
