Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard from a moving compactor: a) At the job site, during the installation of an asphalt parking lot, the operator of the compactor roller was observed getting off the vehicle while the vehicle was in a rear-ward movement, walking to the rear of the vehicle and applying a spray compound to the roller while the vehicle was rolling back-ward without an operator at the controls. This incident occurred on or about May 19, 1998.
