Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
...the hazard of bodily injuries due to a vehicle accident from not being
trained
in the safe operation of tractor-trailers on private property such as
parking lots
and at loading docks when loading or unloading the tractor-trailers on
private
property such as parking lots and at loading docks when loading or
unloading the
tractor-trailers.
On or about September 18, 1995, an employee of Holtgrave Distributing Inc.
was
allowed to operate a tractor-trailer owned by the company on private
property
of
Land-O-Sun Dairy, O'Fallon, Illinois, and the operator had not received any
specific safe-operator training to ensure compliance with, as a minimum,
the
Illinois Department of Transportation CDL (Commercial Driver's License)
requirements.
Among other methods, one feasible and acceptable abatement method would be
to provide safe-operator training using the IDOT guidelines for commercial
drivers for the employees who are required to operate tractor-trailers on
non-
public thoroughfares such as privately owned parking lots and loading
docks;  to
require drivers to maintain plain view of their "spotters"/helpers at all
times.  If
the driver cannot see the helper, the driver shall stop the truck and
physically
leave the cab to locate the helper; and to ensure that the operators
sustain a valid
driver's license while employed to operate the tractor-trailers.
