Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to derailing or tipping over of Portal Crane #3005 and Portal Crane #2226 or accidental running over of employees working in close proximity to Portal Crane #3005 and #2226 while traveling; due to the lack of rail sweeps which extend to the top of the rail and project in front of the leading wheels in either direction: Among other methods, one feasible and acceptable abatement method to correct this hazard is: a) Install manufacturer approved rail sweeps on all leading wheels of the Portal Crane trucks as required by ANSI B30.4-1973, Section 4-1.4(a).
