Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about July 2, 1992, employees were exposed to the hazards of being struck by shag trucks being operated at night without adequate illumination to ensure proper vision while moving and parking the over-the-road semi-truck beef trailers. Among other methods, one feasible and acceptable method to correct this hazard would be: (1) Increase area parking lot lighting; and (2) Ensure all driving lights are on while shag trucks are in operation by controlling them through the ignition switches.
