Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Assembly area, employee was standing on fork elevated on a fork truck exposing them to fall hazard. Employee was repairing an overhead door which lifts to 12 feet. Employee was working above concrete floor. ABATEMENT: Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a safety platform firmly secured to the lifting carriage with appropriate guardrail at a vertical height of 42 inches. In addition, an operator must remain at the controls while personnel are working on the platform.
