Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential injury from crushing caused by the unexpected lowering of lifts or shifting of vehicles while employees work under the vehicle lifts: (a) Wal-Mart Store #80, TBA Service Center. The vehicle lifts and front end alignment lift were inspected and observed to be defective as follows: 1. TBA Service Center, Bay #2. Vehicle lift safety latch was inoperative when the was raised. 2. TBA Service Center, Bay #1. Vehicle lift, left rear pad broken off the restraining arm and pad broken off right front restraining arm. 3. TBA Service Center, Bay #3. Vehicle ilft, left front pad broken off restraining arm. 4. TBA Service Center, Bay #3. Vehicle lift, sticks when raised to the top of stroke. 5. TBA Service Center, Bay #4. Rotary alignment vehicle lift safety latches, on both sides of the lift, which are used to hold the lift when it is in the raised position, did not "click" into place when the lift was raised. Among other methods, one feasible and acceptable abatement method ot correct this hazard is to instal safety devices on all lifts and to have defective parts repaired or replaced in accordance with the manufacturer's recommendations. 1. Develop and implement a visual inspection on the vehicle lifts to assure they are in safe operating condition at the beginning of each shift. 2. Develop and implement a periodic inspection in accordance with the manufacturer's procedures and recommendations. 3. Develop and implement maintenance procedures and care, in accordance with the lift manufacturer's recommendations.
