Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) An oxygen deficient atmosphere or excessive levels of Acetone Vapor
on March 6, 1990 during confined space tank cleaning operations in
yard area.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to develop and implement written standard
operating procedures for entry into confined space vessels, establish
a permit system to ensure safe entry, develop and implement training
for employees and to obtain instruments for measuring and monitoring
atmosphere within the vessels.
