SECTION 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of being struck by unsupported/undersupported braces, trusses, or other structural load bearing members or equipment where braces, keeper pins, cotter pins, "R" pins, clips, or nuts and bolts were not installed or in place to maintain the structural integrity of the carnival ride: a. Keeper pins missing from main attachment pin on the northeast hydraulic erection ram on the Falling Star ride. b. Hinge pin missing on top hinge on light panel boards on the east and west ends of the Jaquar Express ride. c. Keeper pins missing on the automobile support brakets on the Hard Rock Cafe. d. Cotter pins missing on the sign panel braces on the Raiders Kiddie ride. e. Cotter pins missing on 20 diagonal braces on the ground frame and on cross tiein braces on the track for the Super Slide. Among other methods, one feasible and acceptable abatement method to correct this hazard would be: (1) Install cotter and keeper pins where required as indicated by the presence of a hole or slot for such pins as designed by the manufacturer. (2) Conduct daily or set-up inspections to assure that all safety devices are in place.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of being struck by the rotating metal sweeps of the Ferris Wheel. The following conditions contributed to the existence of this hazard: a. On or about April 13, 1993, the employer did not insure that the hoist operator obeyed a stop signal, no matter who gave it when the employee operating the left hoist did not obey the stop signal given by the ride foreman and the hook-up man on the Giant Gondola Wheel #400-003-88, located at 1801 Henderson, Dallas, Texas. Feasible abatement methods to correct this hazard may include, but are not limited to: (1) Requiring the operator to obey the stop signal regardless of who gives it as required by ANSI B30.7 - 1989, Base Mounted Drum Hoists, section 7-3.1.3 (c).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of eing struck by the rotating metal sweeps of the ferris wheel. The following conditions contributed to the existence of the hazard: a. On or about April 13, 1993, the employer had not conducted frequent inspections of the following items for defects and damage on a monthly basis or as specified below, including observations during operation for any defects and damage which might appear between regular inspections: (1) all control mechanisms for maladjustment or excessive wear interfering with proper operation; (2) all limit switches or limiting devices for malfunction at the beginning of each work shift; (3) deterioration or leakage in air or hydraulic systems; (4) load carrying ropes (visual inspection daily for excessive wear and distortion); (5) electrical apparatus for malfunctioning, signs of excessive deterioration, and dirt and moisture accumulation on the two (2) Paccar hoists on the Giant Gondola Wheel #400-003-88 at the carnival site located at 1801 Henderson, Dallas, Texas. Feasible abatement methods to correct this hazard may include, but are not limited to: 1. Develop a program of preventive maintenance that includes frequent and periodic inspections of the following: (i) Hoist mechanism a. Frequent inspection of: all control mechanisms for maladjustment or excessive wear interfering with proper operation; all limit switches or limiting devices for malfunction at the beginning of each work shift; deterioration or leakage in air or hydraulic systems; load carrying ropes; and electrical apparatus as described by ANSI B30.7 - 1989, Base Mounted Drum Hoist, section 72.1.1 (a-e) b. Periodic inspection with written records: deformed, cracked, or corroded members; loose bolts or rivets; cracked or worn drums or sheaves; worn, cracked, or distorted parts such as pins, bearings, shafts, gears, rollers, locking and clamping devices; excessive wear distortion or damage on brake and clutch system parts and linings, and on pawls and ratchets; gasoline, diesel, electric, or other power plants for improper performance and noncompliance with applicable safety requirements; excessive wear of chain drive sprockets and excessive chain stretch; electrical apparatus for contact pitting or any deterioration of controller contractors, limit switches, and push buttons; foundations or supports for continued ability to sustain the imposed loads as described by ANSI B30-7 - 1989, Base Mounted Drum Hoists, section 7-2.1.2. c. Establish a preventative maintenance program based on the hoist manufacturer's recommendations with dated records, as described by ANSI B30.7-1989, Base Mounted Drum Hoists, section 7- 2.3.1. (ii) Wire rope/rigging a. Frequent visual inspections of running ropes for discovering damage such as: distortion of the rope such as kinking, crushing, unstranding, birdcaging, main strand displacement, or core protrusion; general corrosion; broken or cut strands; number, distribution, and type of visible broken wires , as described by ANSI B30.7-1989, Base Mounted Drum Hoists, section 72.4.1(a)(1)(a-d). %% b. Periodic inspections of the entire length of rope for any deteriorations such as: reduction of rope diameter below nominal diameter due to loss of core support, internal or external corrosion, or wear of outside wires; severely corroded, cracked, bent worn, or improperly applied end connections, as described by ANSI B307 1989, Base Mounted Drum Hoists, section 7-2.4.1(b) (2) (a d) and section 7-2.4.1 (b)(3) (a - b). c. Establish a rope replacement program for ropes having the following conditions: in running ropes, six randomly distributed broken wires in one rope lay, or three broken wires in one rope lay, or three broken wires in one strand in one rope lay; one outer wire broken at the contact point with the core of the rope which has worked its way out of the rope structure and protrudes or loops out from the rope structure; wear of one-third the original diameter of outside individual wires; kinking, crushing birdcaging, or any other damage resulting in distortion of the rope structure; evidence of heat damage from any cause; reduction from nominal diameter greater than 1/32 inch, as described by ANSI B30.7 - 1989, Base Mounted Drum Hoists, section 7-2.4.1 (c)(2) (a - f). d. Establish a rope maintenance program of lubrication and damage avoidance according to the manufacturer's recommendations as described in ANSI B30.7-1989, Base Mounted Drum Hoists, section 7-2.4.2 (a-f).
