The alleged violations below have been  grouped  because  they  involve
%%
similar  or  related  hazards  that  may  increase  the  potential  for
illness.
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
(a)  Embalmers who worked in the embalming room at Ted Foster & Sons
Funeral Home were exosed to the hazard of being infected by HBV
through possible direct contact with blood or other body fluids
when performing embalming operations and were not provided with
the HBV vaccination free of charge in amounts and at times
prescribed by standard medical practices.
Among other methods, one feasible and acceptable abatement method
to correcct this hazard is to make available to all the embalmers
and anyone else who may potentially be exposed to blood and/or
other body fluids, the HBV vaccination without cost to the
employees in the amount and at times prescribed by standard
medical practices.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

or serious physical harm to employees in that employees were exposed to:
(a)  Embalmers who worked in the embalming room were exposed to the
hazard of being infected by HBV and/or HIV through possible
direct contact with blood or other body fluids when performing
embalming operations, and were not provided appropriate medical
follow-up procedures.
Feasible and useful abatement methods for reducing this hazard
among others include:
Implementation of follow-up procedures after possible exposure
to HIV and/or HBV.
If an embalmer has a percutaneous (needlestick or cut) or mucosa
membrane (splash to eye, nasal mucosa, or mouth), exposure to
body fluids, or has a cutaneous exposure to blood when the
worker's skin is chapped, abraded, or otherwise non-intact, the
source patient, or case, shall be tested for HIV and HBV
infections to determine the presence of the HIV or HBV virus,
if possible.  (NOTE: In most cases, hospital reports will
indicate the presence of the HIV and/or HBV infection, if known).
The embalmer shall also be evaluated clinically, and by HIV
antibody testing as soon as possible, and be advised to report
and seek medical evaluation, if any acute febrile illness occurs
within 12 weeks after exposure.  HIV seronegative workers shall
be retested 6 weeks post-exposure and on a periodic basis
thereafter (12 weeks) and 6 months after exposure.
Follow-up procedures taken for embalmers exposed or potentially
exposed to HBV shall depend on the immunization status of the
worker (that is, whether HBV vaccination has been received and
antibody response is adequate) and the HBV serologic status of
the source patient or case.  The Center for Disease Control
Immunization Practices Advisory Committee has published its
recommendations regarding HBV post-exposure prophylaxis in table
format in the June 17, 1985 Morbidity and Mortality Weekly
Report.
