Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of infection by HBV and/or HIV through direct
contact with blood and body fluids and for dental workers who handle
contaminated material:
(a)  Appropriate training procedures were not implemented for
dental workers who handle material contaminated with blood
and body fluids.  Feasible and useful abatement methods for
reducing this hazard, among others, are:
(1)  Implementation of training procedures such that the
training provided includes an explanation of the
epidemiology and symptoms of HIV/HBV.
(2)  Implementation of training procedures such that the
training provided includes information on the proper
disposal of contaminated material and personal protec-
tive equipment; including, but not necessarily limited
to 2X2 gauze, bibs, wipes used to clean up the
equipment, wipes used to soak up saliva/blood, foam
mouth pieces, packages that contained x-ray film and
surgical gloves, into proper designated containers.
(3)  Implementation of training procedures such that the
training provided includes an explanation of the method
of infection control defined as "Universal precautions".
(4)  Information on the hepatitis B vaccine, including
information on its efficacy, safety and the benefits
of being vaccinated.
(5)  An explanation of the procedure to follow if an exposure
incident occurs, including the method of reporting the
incident and the medical follow-up that will be made
available.  Also information on the medical counseling
that the employer is providing for exposed individuals.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that:
(a)  Apropriate medical follow-up procedures were not implemented
for dental workers in job categories I and II located
throughout the dental office who were exposed to the hazard
of being potentially infected by HBV and/or HIV through
direct contact with blood or other body fluids.  Feasible
and useful abatement methods for reducing this hazard among
others are:
(1)  Implementation of follow-up procedures after
possible exposure to HIV/HBV, such that if source
patient consent is refused or if the source patient
tests positive, the dental workers shall be
evaluated clinically and by HIV antibody testing as
soon as possible and advised to report and seek
medical evaluation of any acute febrile illness
that occurs within 12 weeks after exposure.  HIV
seronegative workers shall be retested 6 weeks
post-exposure and on a periodic basis thereafter.
(12 weeks and 6 months after exposure).
